These Terms of Service ("Terms") govern your access to and use of the FlavorBiscuit website located at flavorbiscuit.com (the "Site"), operated by FlavorBiscuit ("we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Use of the Site

    You may use the Site for personal, non-commercial purposes only. You agree not to:
  • Use the Site for any unlawful purpose or in violation of these Terms.
  • Scrape, crawl, or systematically copy content from the Site without our prior written permission.
  • Attempt to gain unauthorized access to any part of the Site or its infrastructure.
  • Use the Site to distribute spam, malware, or other harmful content.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.
  • Use any data from the Site for the development of any software program, including training a machine learning or artificial intelligence system.

2. User Accounts

    Certain features of the Site may require you to create an account. You are responsible for:
  • Maintaining the confidentiality of your login credentials.
  • All activity that occurs under your account.
  • Providing accurate and current information when creating your account.

We reserve the right to suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or engaged in conduct harmful to other users or the Site.

3. User-Submitted Content

a) Submission of Recipes

Registered users may submit recipes for publication on the Site. By submitting a recipe, you represent that: (i) the recipe is your original work or you have the rights to submit it; (ii) it does not infringe the intellectual property rights of any third party; and (iii) it complies with these Terms.

b) Moderation and Approval

We reserve the right, in our sole discretion, to review, approve, reject, edit, or remove any submitted recipe at any time and for any reason, without notice or liability. Submission of a recipe does not guarantee publication. We have no obligation to pre-screen submissions but may do so at our discretion.

c) License to Your Content

By submitting a recipe or any other content to the Site ("User Content"), you grant FlavorBiscuit a non-exclusive, royalty-free, worldwide, perpetual license to use, display, reproduce, modify, distribute, and create derivative works from that content in connection with operating and promoting the Site. You will not receive compensation for User Content.

d) Ratings

Registered users may submit ratings for recipes on the Site. Ratings are User Content and do not represent the views of FlavorBiscuit. You agree to base any rating only on your genuine, first-hand experience with the recipe. We reserve the right to remove ratings that we determine, in our sole discretion, to be fraudulent, manipulated, or otherwise in violation of these Terms.

e) Reviews

This section is not currently active and will apply when this feature is introduced.

Written reviews submitted by users are User Content and do not represent the views of FlavorBiscuit. To the fullest extent permitted by law, FlavorBiscuit does not assume liability for reviews or for any claims arising from them. You agree not to submit a review in exchange for payment or other benefits, and not to submit a review for any recipe in which you have a competitive or financial interest.

f) Prohibited Content

    You agree not to submit any User Content that:
  • Infringes any patent, trademark, copyright, or other intellectual property right of any person or entity.
  • Is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, or fraudulent.
  • Contains viruses, malware, or other harmful code.
  • Constitutes unauthorized advertising or spam.
  • Impersonates any person or misrepresents your affiliation with any entity.

4. Site Content and Intellectual Property

All non-user-generated content on the Site, including recipes, text, images, graphics, and other materials created or published by FlavorBiscuit, is owned by or licensed to FlavorBiscuit and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from Site content without our prior written permission, except for personal, non-commercial use (e.g., printing a recipe for your own kitchen use).

5. Affiliate Links and Advertising

FlavorBiscuit participates in the Amazon Services LLC Associates Program and may contain affiliate links to Amazon and other third-party sites. If you click an affiliate link and make a purchase, we may earn a commission at no additional cost to you.

The Site may display third-party advertisements served by Google AdSense or similar networks. We do not endorse any advertised products or services.

All affiliate relationships and sponsored content will be disclosed in accordance with FTC guidelines.

6. Third-Party Links

The Site may contain links to third-party websites. These links are provided for your convenience only. We have no control over the content of those sites and accept no responsibility for them or for any loss or damage that may arise from your use of them.

7. Paid Memberships

This section is not currently active and will apply when this feature is introduced.

a) Billing

Paid memberships are billed on a monthly or annual basis. You authorize us to charge your payment method on a recurring basis until you cancel. All fees are stated in US dollars and are non-refundable except as described below.

b) Cancellation

You may cancel your membership at any time through your account settings. Cancellation will take effect at the end of your current billing period, and you will retain access to member features until that date.

c) Refunds

We do not offer refunds for partial billing periods. First-time subscribers may request a full refund within 30 days of their initial charge by contacting us at fb@flavorbiscuit.com. Refund requests after 30 days will not be honored.

d) Price Changes

We reserve the right to change membership pricing with at least 30 days notice. Continued use of the membership after a price change constitutes acceptance of the new pricing.

8. Electronic Communications

By creating an account or otherwise providing your email address to FlavorBiscuit, you consent to receive communications from us electronically, including via email and notices posted on the Site. You agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing. This does not affect any statutory rights you may have.

9. Copyright Infringement (DMCA)

    FlavorBiscuit respects the intellectual property rights of others. If you believe that content on the Site infringes your copyright, please send a notice containing the following information to our designated contact:
  • An electronic or physical signature of the person authorized to act on behalf of the copyright owner.
  • A description of the copyrighted work you claim has been infringed.
  • A description of where the allegedly infringing material is located on the Site (e.g., the URL).
  • Your name, address, telephone number, and email address.
  • A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  • A statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

We reserve the right to remove content alleged to be infringing and to terminate the accounts of repeat infringers.

10. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

Recipe content on this Site is provided for informational purposes only. Always use your own judgment regarding food safety, allergens, and dietary suitability for your specific situation. FlavorBiscuit is not a substitute for professional nutritional or medical advice.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FLAVORBISCUIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

UNDER NO CIRCUMSTANCES WILL OUR TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE TOTAL AMOUNT ACTUALLY PAID TO FLAVORBISCUIT BY YOU DURING THE TWELVE-MONTH PERIOD PRIOR TO THE ACT OR OCCURRENCE GIVING RISE TO SUCH LIABILITY, OR (B) FIFTY DOLLARS ($50).

The foregoing cap on liability shall not apply to liability for: (x) death, tangible property damage, or personal injury caused by our gross negligence; or (y) any injury caused by our fraud or fraudulent misrepresentation.

The limitations of damages set forth above are fundamental elements of the basis of the bargain between FlavorBiscuit and you. Some jurisdictions do not allow the exclusion or limitation of certain damages; if those laws apply to you, some or all of the above limitations may not apply and you may have additional rights.

12. Indemnification

You agree to indemnify and hold harmless FlavorBiscuit and its owners, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of: (a) your use of the Site; (b) your violation of these Terms; (c) your User Content, including any claim that it infringes a third party's intellectual property rights; or (d) your violation of any rights of another person or entity.

13. Termination

We may modify, suspend, or discontinue the Site, or suspend or terminate your access to the Site, at any time for any reason or no reason, with or without notice, and without liability to you or any third party. Upon termination, your right to use the Site ceases immediately. Sections 3(c), 4, 10, 11, 12, and 15 will survive any termination of these Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Douglas County, Colorado, and you consent to the personal jurisdiction of those courts.

15. General Provisions

a) Entire Agreement. These Terms constitute the entire agreement between you and FlavorBiscuit with respect to your use of the Site and supersede all prior agreements and understandings.

b) Severability and Waiver. If any provision of these Terms is found to be invalid or unenforceable, that provision will be construed to reflect, as nearly as possible, the original intent of the parties, and the remaining provisions will remain in full force and effect. Any failure by us to enforce any provision of these Terms on one occasion will not be deemed a waiver of that provision or any other provision on any other occasion.

c) Force Majeure. FlavorBiscuit shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including acts of God, war, terrorism, riots, pandemics, fire, floods, or failures of third-party infrastructure.

d) No Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Any attempted assignment in violation of this provision is null and void.

16. Changes to These Terms

We may modify these Terms at any time. When we do, we will update the effective date at the top of this page. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. For material changes, we may provide additional notice, such as an email notification to registered users.
